WHAT HAPPENED ???

​Marduk Chimalli Hernández Castro, 26 years old, is an illustrator, student - Bachelor of Communication and Culture UACM & Design and Visual Communication at the ENAP, UNAM - selected top athlete of the Mexico City of Mexico in Tae Kwon Do and teacher of the same discipline, a sport that has a culture of non-violence and respect for human dignity.

On March 15th, 2013, MARDUK CHIMALLI HERNANDEZ CASTRO, after having accompanied his sister to take public transport, is arrested by two policemen in Mexico City, about 150 m before reaching his home. The arbitrarily arrest was based on the pretext that his clothes (blue pants) looked like the clothe of a person who had just stolen a mobile phone and a ring from MARIANA GARCIA VIA MONTE. Minutes later, he was taken by the patrol in order to "clarify" the situation at the police station (Ministério Publico).



Upon arrival at the Public Ministry No. AZ-3, under Preliminary Investigation FAZ/AZ-3/T3/337/13-03, they locked him away in a cell and from that moment Marduk lost his freedom and contact with what was happening outside, without any investigation or clarification procedure.

MARDUK was arbitrarily arrested, he was not running, offered no resistance, none of the stolen objects were found, he was not identified as the aggressor, and despite being one block from his home he was held responsible.

The first hearing was held on March 15th, 2013, the first proofs of Marduk's defense were filed. However, the complainant did not show, therefore the audience was postponed in order to have more elements to clarify the case. The April 29, 2013, the second hearing was held. Interrogations of the complainant and police officer of the Public Ministry took place. Several misrepresentations and anomalies became evident in the process of Marduk. Although the statement of both the woman and the police were full of inconsistencies and contradictions, the judge determined that another hearing was required to conduct confrontations involving all stakeholders, setting a new hearing date of May 20, 2013.

Being totally innocent of the crime he is accused of, MARDUK is currently experiencing a slow and painful process attempting to prove his innocence and integrity. A process that ordinary and uselessly could last for up to 1 year.

The Human Rights Commission of the Federal District, The NGO “Human Rights Centre Fray Francisco de Vitoria” and the Autonomous University of Mexico City (UACM) are working on the case of Marduk conducting parallel investigations. The Mayor of Mexico City and the Attorney General of Mexico City are aware of the case. But Marduk remains in prison convicted of a crime he did not commit.
